Online Store Terms & Conditions / Regulamin Sklepu Internetowego These regulations define the rules for making purchases in the online store operated by the Seller at www.auronn.com. The Seller is IMU MEDICAL S.A. company, ul. Tadeusza Kościuszki 10/1, 05-500 Piaseczno, KRS: 0001041220, NIP: 123-153-23-29, REGON: 525113864, also referred to interchangeably as the "Service Provider." The Service Provider can be contacted: • by sending a message to the e-mail address: biuro@auronn.com. §1 Definitions 1. Regulations – these regulations. In the scope of services provided electronically, the Regulations are the regulations referred to in Article 8 of the Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws of 2002, No. 144, item 1204, as amended). 2. Customer – a natural person, legal person, or organizational unit without legal personality but with legal capacity, who places an Order on the Website under the terms specified in these Regulations. 3. Consumer – a Customer who is a natural person, using the Website for purposes not directly related to their business or professional activity. 4. Service Provider / Seller – an entity providing sales services via the Online Store under the terms specified in these Regulations, i.e. IMU MEDICAL S.A. company. 5. Subject of the transaction – Goods listed and described on the website of the Online Store. 6. Goods – a movable item presented in the Online Store, to which the Sales Agreement applies. 7. Additional Service – a service provided by the Service Provider to the Customer outside the Online Store in connection with the nature of the Goods sold. 8. Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between the Service Provider and the Customer, using the online service of the Store. 9. Service – an online store available at www.auronn.com, through which the Customer can place an Order. 10. Order – a declaration of intent by the Customer that clearly specifies the type and quantity of Goods, aiming directly at concluding a Sales Agreement. 11. Teleinformatics System – a set of cooperating IT devices and software that ensures processing, storage, sending, and receiving data via telecommunications networks. 12. Delivery – an actual act consisting in the delivery of Goods specified in the Order to the Customer by the Seller/Service Provider. 13. Account – maintained for the Customer by the Service Provider, under a unique name (login), an account that is a set of resources in which the Customer's data and information about their activities within the Service are collected. 14. Login – an e-mail address provided by the Customer, required together with the Password to set up a Customer Account in the Service. 15. Password – a sequence of characters set by the Customer. 16. Registration – a one-time action consisting in setting up an Account by the Customer, performed on the Service website. §2 General Rules 1. These Regulations define the rules for using the online store available at www.auronn.com. 2. The Service Provider enables the placing of an Order via the online store by filling out a form. 3. The condition for placing an Order in the Online Store by the Customer is to read these Regulations and accept their provisions during the execution of the Order. 4. The Store conducts retail sales via the Internet. 5. All Goods offered in the Store are brand new, originally packaged, free from physical and legal defects, and have been legally introduced to the Polish market. 6. As part of the technical requirements necessary to use the Service, the Customer should have: • an active e-mail account, • a device connected to the Internet that meets the following minimum technical requirements: o Internet browser (Chrome, Mozilla Firefox, Internet Explorer, Opera) in the latest version with support for necessary applications enabled, o recommended screen resolution: 1920x1080 pixels. 7. The Customer is obliged not to provide content prohibited by law, e.g., content promoting violence, defamatory, or violating personal rights and other rights of third parties. §3 Placing Orders 1. All prices given on the Website are gross prices in Polish zloty (PLN), including VAT. The prices do not include delivery costs, which are specified when placing an Order. 2. Orders can be placed via the website by completing the appropriate form. 3. Orders can be placed 24 hours a day, 7 days a week. 4. To place an Order, the Customer must correctly fill in the order form and provide the data necessary for the execution of the Order, such as delivery address and contact details. 5. The condition for the effective submission of an Order is the acceptance of these Regulations by the Customer. 6. In the event of circumstances that make it impossible to fully or temporarily fulfill the Order, the Service Provider reserves the right to suspend the execution of the Order, about which the Customer will be immediately informed. 7. Orders in which the form has been filled out incorrectly or incompletely may not be accepted. 8. The Customer will receive confirmation of acceptance of the Order by e-mail. 9. The commencement of the Order’s processing begins upon receipt of the payment or, if the option of cash on delivery is chosen, immediately after the Order is confirmed by the Service Provider. §4 Delivery 1. The ordered Goods are delivered to the address indicated by the Customer when placing the Order. 2. The Goods are delivered by courier companies or other delivery methods available in the Online Store. 3. The delivery costs are specified during the Order placement process and are borne by the Customer. 4. The Customer is obliged to check the delivered shipment at the time of receipt. If any damage to the shipment or Goods is found, the Customer should prepare a damage report in the presence of the courier. §5 Payments 1. The Service Provider provides the following payment methods: • by bank transfer to the Service Provider's account, • via electronic payment systems (if available in the Store), • cash on delivery. 2. The Customer is obliged to pay the price for the ordered Goods, including delivery costs, within 7 days of placing the Order, unless another deadline is specified in the Order confirmation. §6 Complaints 1. The Service Provider is liable to the Customer if the Goods have a physical or legal defect (warranty). 2. Complaints regarding ordered Goods can be submitted via e-mail to: biuro@auronn.com or in writing to the address of the Service Provider’s registered office. 3. When submitting a complaint, the Customer should provide a description of the defect and proof of purchase. 4. The Service Provider will respond to the complaint within 14 calendar days. §7 Right of Withdrawal 1. A Consumer who has concluded a distance contract may withdraw from it without giving any reason by submitting an appropriate statement in writing within 14 days from the date of receiving the Goods. 2. To meet the deadline, it is sufficient to send the statement before the deadline expires. 3. The returned Goods should be complete, must not bear traces of use beyond what is necessary to establish the nature, characteristics, and functioning of the Goods, and should, if possible, be returned in the original packaging. 4. The costs of returning the Goods are borne by the Consumer. 5. The Service Provider shall refund the payment to the Consumer within 14 days of receiving the withdrawal statement, but may withhold the refund until the Goods are returned. §8 Privacy Policy and Protection of Personal Data 1. The administrator of the personal data database provided by customers of the online store in connection with purchases is the Service Provider (IMU MEDICAL joint-stock company). 2. By accepting the Regulations, the Customer consents to the processing of their personal data by the Service Provider in accordance with the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926, as amended), to the extent necessary for the provision of the service. 3. Customers have the right to access their data and to correct it. The provision of data is voluntary. 4. Information on the methods and technical means for detecting and correcting errors in entered data: 1. When placing an Order, until clicking the “Place Order” button, customers with an account in the online store can independently correct entered data by editing their account profile. 2. Verification of data or correction of the Order can also be made by sending an e-mail to the Service Provider at: biuro@auronn.com. 3. The Customer may change the data entered when creating an Account at any time using the available options. 5. Information on the rules and methods of recording, securing, and making available to the other party the content of the concluded contract by the Service Provider: 1. The recording, securing, and making available of the content of the concluded Sales Agreement is carried out by sending an appropriate e-mail after concluding the Sales Agreement. 2. The recording, securing, and making available of the content of the concluded Sales Agreement is also done by sending the Customer the content of the agreement to the provided e-mail address or by providing the Customer with the order specification and proof of purchase. 3. The content of the concluded agreement is additionally recorded and secured in the Service Provider's teleinformatics system and made available to the Customer upon request. §9 Amendment of the Regulations 1. The Seller reserves the right to amend the content of these Regulations and to launch a new version of the Service at any time and without giving reasons. 2. Customers with an account in the Service will be informed of the amendment to the Regulations via e-mail correspondence with 14 days’ notice. 3. If the Regulations have changed since the Customer’s last login, the Customer accepts or rejects the amended provisions. In the event of non-acceptance of the Regulations— particularly after amendments—purchases in the online store will not be possible. 4. A Customer who does not accept the introduced changes has the right to delete their account at any time. 5. Orders placed by Customers before the entry into force of amendments to the Regulations will be executed in accordance with the existing provisions of the Regulations. §10 Newsletter 1. These provisions govern the Newsletter service, which enables the conclusion of an agreement for the delivery of free digital content by the owner of the website to the website user (hereinafter: “website user”). Under the Newsletter service, the website user does not make a monetary payment but provides their data to the website owner. 2. The Newsletter service consists of the periodic, free sending by the website owner to the e mail address provided by the website user of information of a commercial and marketing nature regarding the website. 3. Use of the Newsletter service is available to every website user after providing their e-mail address (or other data specified in the Newsletter signup form) in the part of the website dedicated to the Newsletter service, and then accepting the Newsletter signup. After clicking the “SUBSCRIBE” (or equivalent) button, an activation link will be sent to the user—clicking the link activates the Newsletter service. 4. Activation of the Newsletter service constitutes the website user’s consent to the sending of marketing and commercial information by electronic means as defined by the Act on the Provision of Electronic Services, as well as consent to the use by the website owner of telecommunications terminal equipment for direct marketing purposes as defined by the Telecommunications Law. 5. Consent given by the website user is voluntary but necessary to launch the Newsletter service—lack of consent means the service cannot be provided. 6. The website user may at any time, without giving a reason, unsubscribe from the Newsletter service: • by clicking the “UNSUBSCRIBE” button located in each message sent by the website owner as part of the Newsletter service, • by sending an e-mail to: biuro@auronn.com. 7. Unsubscribing results in the immediate termination of the Newsletter service—the website user stops receiving messages under the service, and the user’s data is deleted from the Newsletter recipient database. 8. All content provided under the Newsletter service is protected by copyright belonging to the website owner. 9. The website user may file a complaint about the Newsletter service by sending an e-mail to: biuro@auronn.com. The complaint should include data enabling identification of the website user, a description of the irregularity, and the claim. The complaint will be processed within 14 days. The user will be informed of the outcome via e-mail. 10. A website user who is a consumer may use out-of-court complaint and redress mechanisms in matters related to the Newsletter service. 11. Information on the processing of personal data under the Newsletter service is available at www.auronn.com. 12. The website owner is entitled to make changes to these Regulations. Changes will be announced by publishing the new Regulations on www.auronn.com. Amendments enter into force 7 days from the date of their announcement. 13. The website user will be informed of amendments to the Regulations via an e-mail sent to the provided e-mail address. §11 Final Provisions 1. In matters not regulated by these Regulations, the following provisions shall apply: • Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws 2000 No. 22, item 271, as amended), • Act of 27 July 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws 2002 No. 141, item 1176, as amended), • Act of 23 April 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended). 2. Disputes arising from the application of these Regulations and in connection with the performance of contracts concluded between the Store and Customers shall be resolved by the court having jurisdiction in accordance with the provisions on subject matter and local jurisdiction under the Act of 17 November 1964 – Code of Civil Procedure (Journal of Laws No. 43, item 296, as amended).
